Welcome to RentAid ("we," "our," or "us"). RentAid is operated by RentAid Private Limited, an Indian company registered under The Companies Act, 2013. RentAid specializes in enhancing real estate management and urban property leasing through user-friendly Software as a Service ("SaaS") solutions.
Our core focus lies in software development, particularly internet and mobile applications tailored to manage, streamline, and audit residential and commercial leasing workflows. RentAid's integrated ecosystem includes:
- Tenant Website & Mobile Application (B2C)
- Property Owner / Landlord Website & Mobile Application (B2B & B2C)
Throughout these Terms, pronouns such as "us," "we," and "our" pertain to the Company, while references to "you," "your," or "user" denote individuals or enterprise entities engaging with the website or any application within the RentAid suite.
By subscribing to, downloading, accessing, or using our services via the Website or Mobile Application, you agree to abide by these Terms of Use ("Terms"). It is important to carefully read and understand these Terms. Your use of our services constitutes full legal acceptance of these Terms, regardless of the delivery mechanism or access method.
We reserve the right to modify these Terms at any time, with or without prior notice. Continued use of the platform following updates indicates acceptance of the revised Terms. We also reserve the right to deny access or terminate service to anyone who, in our sole discretion, violates any provision of these Terms.
1. Eligibility & Account Security
- Age Requirement and Legal Capacity: You must be at least 18 years old to use our services. We reserve the absolute right to terminate platform membership and deny access to anyone under 18 years of age. Use of the platform requires the execution of data and contractual actions only fit for legally contracting adults.
- Account Creation: Registration requires providing accurate, complete, and current information, including a legitimate email address, active mobile number, and obtaining an e-KYC for verifying Government ID/s. Each user is permitted only one registered profile. Any falsification or misrepresentation will result in immediate rejection or termination of registration.
- Account Responsibility: You are solely responsible for maintaining the strict confidentiality of your account credentials and password, and for monitoring access to your devices. You agree to accept full responsibility for all activities that occur under your account. We shall not be liable for any loss or damage resulting from your failure to protect your account details.
- Breach Notification: If you suspect unauthorized use of your account or an active breach of security, you must notify us immediately via our designated support or grievance channels.
2. Platform Role & Limitations
- Intermediary Status: RentAid acts strictly as a technology intermediary and SaaS platform provider connecting prospective tenants with property owners or managers. We are not a real estate broker, insurance agent, or a direct contracting party to the lease.
- No Guarantee: We do not own, manage, or control the physical properties listed on the Platform. We do not guarantee the physical condition, legality, or safety of any property, nor do we guarantee the absolute financial creditworthiness or character of any platform participant. However, we are open to hearing from you in case of any such lapses regarding properties & people listed on the platform and take corrective actions.
- Independent Contracts: Any lease, license, or rental agreement formed is strictly a bilateral contract between the Tenant and the Landlord. RentAid is not a party to these agreements and holds zero liability for disputes arising from lease tenures, security deposit forfeitures, or property damage.
3. Platform Conduct & Prohibited Uses
You agree to use our SaaS suites in strict compliance with all applicable municipal, state, and national laws. Illegal or unauthorized use is strictly prohibited. You agree NOT to:
- Access or attempt to use the platform through unauthorized mechanisms, scripts, or scrapers.
- Copy, modify, create derivative works of, or publicly display any part of the platform's proprietary software interface.
- Reverse engineer, decompile, or attempt to extract the source code of our applications or backend infrastructure.
- Alter, mask, or remove any copyright notices, corporate markings, or hyperlinks embedded within the suites.
- Register a false or frivolous grievance, or impersonate another individual or entity while providing data during background or verification checks.
4. Fraud and Legal Remedies
We reserve the right to pursue strict civil and criminal legal action, and recover damages (including comprehensive attorney's fees and investigative costs) for any fraudulent use of our suites, application manipulation, financial misrepresentation, or illicit activity conducted on our network.
5. System Up-time & Service Discontinuities
While we take utmost care in preparing, optimization, and maintaining our infrastructure up-time, certain technical issues, carrier disruptions, cloud server outages, or maintenance requirements beyond our control may occasionally disrupt or suspend access. Therefore, we cannot guarantee uninterrupted access at all times, and platform availability is subject to operational variations.
6. Intellectual Property Rights & Licensing
- Ownership: You acknowledge and agree that the Company (and its licensors or suppliers) owns all legal rights, title, and interest in the software suites, applications, code architecture, brand layout, logos, text, and graphics, including all associated intellectual property rights globally.
- Grant of License: The Company grants you a personal, worldwide, royalty-free, non-assignable, and non-exclusive license to use the applications exactly as provided to you, strictly within the boundaries of these Terms. This license is granted solely to facilitate your utilization of the leasing management tools.
- User Data: The Company does not claim ownership over your personal data and respects your corporate and individual privacy rights. Data collection, storage, and processing are governed strictly by our DPDP-compliant Privacy Policy (updated from time to time) which can be found on our Website & Mobile Applications.
7. Mandatory Electronic Communications
When you use our Website or Mobile Applications, you explicitly consent to receive communications from us via email, SMS, automated phone calls, in-app/website chat box, push notifications, or platform alerts. You agree that all electronic notices, disclosures, and agreements provided through these channels fully satisfy any legal requirements that such communications be in writing.
8. Exclusion of Warranties
The RentAid suite, application tools, analytics, and associated services are provided entirely on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied. Your use of the suite is entirely at your own risk. We do not guarantee that the software will meet all your exact operational requirements, operate completely error-free, provide absolute data accuracy, or that all system defects will be immediately corrected.
9. Limitation of Liability & Disclaimers
We are not liable for any errors, network latency, or technical issues encountered while using this site or our applications. The Company disclaims all liability for any indirect, special, incidental, punitive, or consequential damages arising out of the use or inability to use this platform.
You explicitly acknowledge and agree that RentAid is a technology platform acting strictly as an intermediary and facilitator. RentAid does not own, control, manage, or inspect any of the properties listed or recommended. RentAid is not a party to your lease or leave-and-license agreement, nor do we act as a real estate agent or broker in your transaction.
RentAid shall bear no liability whatsoever for the acts, omissions, negligence, or willful misconduct of any landlord, property owner, broker, or other third party. We do not guarantee the condition, legality, safety, or suitability of any property. Any disputes regarding property conditions, security deposit refunds, lease terminations, or landlord-tenant relations are strictly between you and the respective landlord.
Limitation of Liability: (a) To the fullest extent permitted by law, RentAid, its affiliates, officers, employees, and agents shall not be liable to you for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to financial losses, relocation delays, temporary accommodation costs, emotional distress, loss of data resulting from your use of or inability to use the Platform.
(b) Absolute Cap: Because RentAid provides this platform to you entirely free of brokerage charges or service fees, our total, aggregate liability to you for any and all claims arising out of your use of the Platform, the Services, or interactions with third parties, whether in contract, tort (including negligence), or otherwise, shall be strictly limited to exactly INR 0.00 (Zero Rupees). In jurisdictions or circumstances where a total exclusion of liability is deemed unenforceable by a court of competent jurisdiction, RentAid's total aggregate liability for all claims shall be strictly and unequivocally capped at a nominal, maximum amount of INR 1,000 (Indian Rupees One Thousand only).
10. Indemnity
You agree to indemnify, defend, and hold the Company, its directors, officers, employees, users and vendors harmless from any third-party claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from your direct actions or inactions, your breach of this User Agreement, your misuse of platform features, or your violation of any municipal or national laws.
11. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes, claims, or legal proceedings arising out of or in connection with these Terms or the use of our applications shall be subject to the exclusive jurisdiction of the competent courts located in Hyderabad, Telangana.
12. User-Generated Content (UGC) and Listings
The Platform allows Landlords to upload property details, photos, and descriptions ("UGC"). RentAid does not pre-screen or claim ownership of this UGC. By uploading UGC, you grant RentAid a non-exclusive, worldwide, royalty-free license to use, display, and distribute this content to facilitate our services. We do not guarantee the accuracy, completeness, or actual physical condition of any property based on its UGC. RentAid shall not be liable for any direct or indirect losses resulting from a Tenant relying on inaccurate property listings.
13. Payment Intermediary & Chargebacks
For rent and security deposit payments made through the Platform, RentAid acts solely as a payment facilitator. We do not guarantee payment on behalf of any Tenant. In the event a transaction is disputed, reversed, or flagged as fraudulent by a bank or payment network (a "Chargeback"), the responsible User must immediately reimburse RentAid for the Chargeback amount and any associated penalties. RentAid reserves the right to delay, suspend, or reject any transaction that we suspect violates these Terms or poses a financial risk.
14. Telecom Registry Override
By registering on the Platform and providing your phone number, you explicitly authorize RentAid, its representatives, and authorized third-party partners to contact you via phone calls, SMS, WhatsApp, and emails regarding your account, property matches, and promotional offers. You agree that this authorization overrides any registration you may have with the National Do Not Call Registry (NDNC) or National Consumer Preference Registry (NCPR). You undertake not to file complaints with the Telecom Regulatory Authority of India (TRAI) regarding communications from RentAid, provided such communications are directly related to the Platform's services.
15. Credit Bureau & Background Checks
Credit Bureau & Background Checks: If a Landlord requires financial vetting, or if you apply for specific rental guarantee services, you expressly consent to RentAid acting as your authorized representative to retrieve your Credit Information from credit bureaus (e.g., CIBIL, Experian, Equifax). RentAid will process this Credit Information strictly for the limited purpose of evaluating your rental eligibility and will purge this data in compliance with the DPDP Act and the Credit Information Companies (Regulation) Act, 2005.
Platform Trust Score and Automated Profiling: RentAid utilizes automated algorithms to analyze your platform interactions, profile completeness, background check results, and verified credentials to generate a "Trust Score" or user rating. This rating is designed to enhance platform safety, build community trust, and facilitate better property matching. You acknowledge and consent to this automated profiling as detailed in our Privacy Policy. Please note that RentAid provides this score for informational purposes only; it is not a definitive guarantee of the financial capability, reliability, or moral character of any Tenant or Landlord.
Identity Verification and e-KYC: To maintain a secure marketplace and prevent fraud, RentAid requires users to complete an electronic Know Your Customer (e-KYC) verification process before engaging in property transactions. This involves the submission and authentication of government-issued identification (such as a Masked Aadhaar, PAN card, or Voter ID) through our DPDP-compliant third-party verification partners. You legally attest that all identification documents provided are authentic and belong to you. In adherence to data minimization principles, RentAid does not store raw, unmasked Aadhaar numbers, and processes all identity data solely for the purpose of mandatory verification.
16. Law Enforcement Agency (LEA) Assistance
RentAid cooperates fully with law enforcement and cybercrime authorities. LEAs seeking assistance or user details pursuant to a valid legal request may contact our dedicated legal desk at [Insert LEA Email, e.g., legal@rentaid.com]. Users suspecting fraud on the Platform should immediately report the listing via the in-app reporting tool or by contacting [Insert Fraud Helpdesk Email].
